Premises Claims



In Florida, depending on your purpose for being on a property, the owner must generally keep its property reasonably safe and warn you of any known dangers, unless they are obvious.



When an injury is caused by a defective condition on the property, such as a fall due to faulty lighting or a substance left on a floor,  it is your obligation to establish why the accident happened.


I advise you to take photos, document the condition and report the fall to the business. Be sure to note the time and date, who was told of the incident, any comments about the condition made by employees as to their knowledge of the condition and the names and contact information for any witnesses.


Injuries caused by criminal conduct are different. Criminals are opportunists and typically target poorly protected properties.  Owners of hotels, apartments and other venues who know when their businesses are located in a high-crime area and must warn you about those risks and to take more aggressive security measures to keep you safe.



If you are injured while shopping at a business, or staying in a hotel or apartment complex, call immediately so that valuable evidence is not lost.
